K Secure Systems Sdn. Bhd. – Terms & Conditions
K Secure Systems Sdn. Bhd. (“K Secure”, “we”, “our”, or “us”) provides products and services including but not limited to CCTV systems, access control systems, biometric attendance systems, cloud services, networking, IT solutions, security systems, websites, hosting, and related technologies.

By purchasing, using, accessing, or continuing to use our products, systems, services, websites, cloud platforms, software, or technical support, the customer (“Customer”, “you”, or “your”) agrees to the following Terms & Conditions.

These Terms & Conditions should be read together with our Privacy Policy, Cookie Policy, and Legal Notice where applicable.


1. Products & Services
All products and services supplied by K Secure are provided on a best-effort basis and are intended to assist in improving operational efficiency, monitoring, access management, security, and system automation.

Our systems and services do not guarantee prevention of theft, intrusion, unauthorized access, misconduct, data loss, cyber incidents, operational interruption, or any other incident.


2. Quotations & Pricing
All quotations are valid for the period stated in the quotation unless otherwise specified.

Prices, specifications, features, software compatibility, cloud availability, and service offerings may change without prior notice.

Additional work, modifications, onsite visits, retraining, troubleshooting, recovery services, reconfiguration, or requests outside the original agreed scope may be subject to additional charges.


3. Payment Terms
Unless otherwise agreed in writing, full payment shall be made according to the agreed payment schedule.

K Secure reserves the right to suspend services, cloud access, maintenance, support, or related services for overdue accounts.

Products, licenses, cloud subscriptions, software access, and related services may remain under K Secure’s ownership until full payment is received.


4. Warranty
Selected products may include limited manufacturer warranty coverage subject to the respective manufacturer’s warranty policies and limitations.

Warranty does not cover:
  • misuse,
  • negligence,
  • power surges,
  • lightning,
  • water damage,
  • environmental damage,
  • malware,
  • ransomware,
  • improper usage,
  • unauthorized modification,
  • third-party accessories,
  • unsupported configurations,
  • self-repair,
  • customer tampering,
  • internet interruption,
  • cloud interruption,
  • storage failure,
  • normal wear and tear,
  • or events beyond reasonable control.
Warranty may be void if:
  • products are opened, modified, repaired, relocated, or serviced by unauthorized persons;
  • serial numbers or warranty labels are removed or damaged;
  • unofficial, incompatible, or non-approved accessories or components are used.


5. Third-Party Products & Services
Certain products, software, cloud platforms, hosting services, hardware, firmware, licenses, applications, and online services supplied by K Secure may be provided by third-party manufacturers, vendors, or providers.

Such third-party products and services are subject to their own terms, warranties, limitations, availability, and support policies.

K Secure shall not be responsible for failures, outages, changes, discontinuation, data loss, security incidents, subscription issues, compatibility issues, or interruptions caused by third-party products or services.


6. Cloud Services, Hosting & Websites
Cloud services, websites, hosting services, remote access systems, backups, and online platforms are provided on a best-effort basis.

K Secure does not guarantee:
  • uninterrupted availability,
  • permanent data retention,
  • error-free operation,
  • continuous uptime,
  • uninterrupted internet connectivity,
  • or immunity from cyber attacks or technical failures.
Customers are responsible for maintaining appropriate backups and security practices where necessary.


7. CCTV, Recordings & Surveillance
CCTV recordings and stored data may be affected by:
  • hardware failure,
  • storage limitations,
  • overwrite settings,
  • internet interruption,
  • software malfunction,
  • power failure,
  • user actions,
  • environmental conditions,
  • or third-party services.

Customers are responsible for ensuring CCTV cameras, sensors, and related equipment remain properly positioned, unobstructed, powered, and appropriately maintained after installation.

K Secure shall not be liable for incidents arising from:
  • repositioning of cameras,
  • obstruction,
  • customer modifications,
  • deleted recordings,
  • overwritten recordings,
  • inaccessible footage,
  • improper storage management,
  • or failure to review recordings promptly.

Customers are solely responsible for the use, sharing, disclosure, export, publication, and management of CCTV recordings and surveillance data.


8. Access Control, HR Attendance & User Management
Customers are solely responsible for:
  • managing employee accounts,
  • attendance settings,
  • overtime settings,
  • payroll verification,
  • shift configurations,
  • access permissions,
  • passwords,
  • cards,
  • biometric records,
  • user accounts,
  • and administrative controls.

K Secure shall not be liable for:
  • payroll discrepancies,
  • attendance manipulation,
  • unauthorized access,
  • theft,
  • misuse of credentials,
  • failure to remove former employee access,
  • incorrect HR settings,
  • or losses caused by customer administration errors or unauthorized changes.

Customers are responsible for verifying all attendance and payroll-related data before use for salary or employment purposes.


9. Customer Responsibilities
Customers are responsible for:
  • maintaining proper passwords,
  • backups,
  • antivirus protection,
  • internet connectivity,
  • power supply,
  • UPS protection where necessary,
  • physical security,
  • internal handovers,
  • administrator management,
  • and operational continuity.

Customers are responsible for maintaining proper internal documentation, credentials, access information, and staff handovers.

K Secure shall not be responsible for issues arising from:
  • employee resignation,
  • internal staff changes,
  • missing passwords,
  • missing handover information,
  • customer refusal of training,
  • or improper internal management.


10. Unauthorized Modification & Third-Party Work
Any modification, relocation, tampering, reconfiguration, repair, software installation, firmware upgrade, rewiring, or alteration performed by unauthorized persons may void warranty and release K Secure from related liability.

K Secure shall not be responsible for any malfunction, damage, security issue, data loss, or performance problem caused by:
  • customer modifications,
  • self-repair,
  • third-party technicians,
  • internet providers,
  • software vendors,
  • unofficial accessories,
  • incompatible devices,
  • or unauthorized personnel.

Customers operating or modifying systems without proper knowledge or training do so at their own risk.


11. Data Loss & System Recovery
K Secure shall not be liable for:
  • loss of data,
  • deleted files,
  • corrupted data,
  • overwritten recordings,
  • database damage,
  • formatting,
  • ransomware,
  • malware,
  • cyber attacks,
  • failed backups,
  • synchronization issues,
  • or accidental deletion caused by customers, employees, third parties, or events beyond reasonable control.

Where possible, K Secure may provide recovery assistance or troubleshooting support subject to technical feasibility and applicable service charges.

Data recovery is not guaranteed.


12. Support & Training
K Secure may provide training, support, onboarding, maintenance, troubleshooting, or guidance based on the agreed service scope.

Additional support, retraining, onsite visits, recovery services, technical assistance, reconfiguration, or consultation outside the original agreed scope may be chargeable.

Where additional training or support is recommended by K Secure but declined by the customer, the customer assumes responsibility for resulting misuse, operational issues, configuration errors, or data loss.


13. Limitation of Liability
To the maximum extent permitted by applicable law, K Secure shall not be liable for:
  • indirect losses,
  • consequential losses,
  • special damages,
  • punitive damages,
  • loss of profits,
  • loss of business,
  • loss of goodwill,
  • business interruption,
  • loss of reputation,
  • loss of opportunity,
  • or third-party claims.

K Secure’s total liability, whether in contract, negligence, tort, statutory duty, or otherwise, shall not exceed the amount actually paid by the customer for the affected product or service.


14. Website Usage & Intellectual Property
All content, trademarks, logos, graphics, documents, software, images, and materials provided by K Secure remain the intellectual property of K Secure or its respective owners unless otherwise stated.

Customers and visitors may not reproduce, redistribute, modify, republish, reverse engineer, or commercially exploit any materials without written permission.


15. External Links & Third-Party Content
Our websites or systems may contain links or integrations to third-party platforms or services.

K Secure has no control over such third-party content or services and makes no representations regarding their availability, security, accuracy, or reliability.


16. Changes to Terms
K Secure reserves the right to modify, update, add, or remove any part of these Terms & Conditions at any time without prior notice.

The latest version published by K Secure shall apply.


17. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Malaysia.
